ATO Tax Residency Review
& Representation

A letter from the Australian Taxation Office lands, and your stomach drops. Most accountants quietly fold; we don't. When the assessment is wrong, the position is technical, and a serious amount sits on the outcome, this is where our deep tax law expertise pays for itself many times over.

§ 01

Who this is for.

Expat affairs draw scrutiny - residency reviews, audits, objections and complex ruling applications are part of the territory when your tax life crosses borders. The outcomes are rarely small, and the technical ground is exactly where most advisors are least comfortable.

This service is for anyone facing the ATO on a contested position, or who needs certainty in advance: a residency review, an audit, an objection to an assessment, or a private binding ruling on a finely balanced point. Our directors argue these matters personally.

§ 02

What this covers.

01

Residency reviews

The ATO's favourite question for expats, and the one with the most at stake. We build and defend the position on the facts, the tests and the case law.

02

Audits and assessments

When the assessment is wrong - or the data-matching has drawn the wrong conclusion - we engage, evidence the real position, and push back.

03

Objections

A formal objection is a technical document, not a complaint letter. We frame the legal argument the way the ATO has to respond to.

04

Private binding rulings

Where a position is genuinely finely balanced, a ruling buys certainty in advance. We prepare and argue the most complex applications.

05

Penalties and interest

Much of the real exposure sits in penalties and shortfall interest. Remission is an argument in its own right, and we run it.

06

Voluntary disclosures

Coming forward on the front foot - properly framed - is almost always better than being found. We manage the disclosure and the negotiation.

§ 03

How we help.

01 / 05

Residency review defence

The position built on the tests and case law, and argued through the review.

02 / 05

Audit & assessment representation

Engagement with the ATO, evidenced and argued on your behalf, start to finish.

03 / 05

Objections & appeals

Technical objections drafted to the standard the law requires - and escalated where needed.

04 / 05

Private binding rulings

Complex applications prepared and argued to lock in certainty before you act.

05 / 05

Penalty remission & disclosures

The remission argument run hard, and voluntary disclosures managed to your advantage.

They'd already decided I was a resident for four years. The objection, argued by the Expat Taxes team, turned it around completely.

Don't face the ATO alone.

When the position is technical and the numbers are serious, expert representation pays for itself many times over. Our tax directors argue these matters personally.
